     政院版同婚專法 跨國同婚尚未準用

    現年24歲台灣青年趙守泉與75歲的「英國老爹」Andy日前在苗栗舉行婚姻，傳為佳話，但是行政院院會今（21）日審查通過法務部擬具的同婚專法，並未規範同志跨國婚姻的效力，另外，同性伴侶合併報稅、代理孕母或借精生子等相關規定，專法也尚未準用。對此，法務部指出，因相關議題的主管法條在其他部會，各部會正在斟酌討論檢視中。

    至於跨國同婚規定是否會牽涉其他法律修正，且繼親收養，若有其中一方在婚前已經收養非血緣關係子女，婚後是否能收養？蔡清祥回應，跨國婚姻是比較複雜情形，這次沒把所有狀況考慮進來，是因這並非能立即解決，後續還有很多問題要克服，要經多方討論後看如何納入。他接著說，繼親收養，是在關心目前已經親生兒女的問題，收養又把問題延伸太大，因此暫時不考慮。

    有關同志跨國婚姻效力未納入專法，法務部法律事務司司長鍾瑞蘭說明，因為跨國婚姻是《涉外民事法律》，主管機關是司法院，已經在檢視。另外，代理孕母、借精生子也未納入專法，鍾瑞蘭表示，借精卵生牽涉到《人工生殖法》，主管機關是衛福部，未來修法時也會再和主管機間討論。

    至於姻親、婚約也未納入專法，鍾瑞蘭表示，大法官解釋說不及於民法婚姻章裡面，姻親部分是在婚姻章，所以未納入。另外，婚約未納入的考量，是因為縱使大家使用民法，婚約現在比較少用，所以沒有納入專法。
